  1. Policy statement
    1. Happy Cells ACN 608 204 388   trading as “Pit Stop SEQ” (Pit Stop SEQ) is committed to protecting the privacy of the personal information and sensitive information which it collects and holds.
    1. Pit Stop SEQ must comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth), and other privacy laws which govern the way in which organisations (such as Pit Stop SEQ) hold, use and disclose personal information (including your sensitive information).

      1. how Pit Stop SEQ collects and holds personal information;

    1. whether the information or opinion is recorded in a material form or not;
  3. sensitive information means:
    1. personal information or opinion about an individual’s:
      1. racial or ethnic origins;
      1. political opinions or political associations;
      1. philosophical beliefs or religious beliefs or affiliations;
      1. sexual preferences or practices; or
      1. criminal record; or
    1. health information about an individual; or
    1. genetic information about an individual that is not otherwise health information.
  4. Collection and use of personal information
    1. Pit Stop SEQ will only collect information which is necessary to facilitate the provision to you of services by Pit Stop SEQ or to appropriately manage, conduct and oversee Pit Stop SEQ’s business. This may include (as applicable):

Clients, customers, patients: Pit Stop SEQ collects information from you to facilitate the provision of services to you.  This includes collecting personal information such as your name, address, your health history, family history, past and current treatments, lifestyle factors, and any other information which is necessary to assist Pit Stop SEQ in providing appropriate services.
  6. Students, contractors and volunteers: Pit Stop SEQ collects information from you which is necessary to properly conduct, manage and oversee the Pit Stop SEQ’s business. This includes collecting personal information such as your name, address, professional experience, qualifications and past employers, and any other information which may be necessary to appropriately conduct, manage and oversee Pit Stop SEQ’s business.
  7. Job applicants: Pit Stop SEQ collects information from you which is necessary to assess and engage job applicants. This includes collecting personal information such as your name, address, professional experience, qualifications, references and past employers, and any other information which is necessary to process your job application.
    1. Pit Stop SEQ will usually collect your personal information directly from you, however sometimes we may need to collect information about you from third parties, such as:

  9. past employers and referees.

  20. where required, effectively communicate with third parties, including Medicare Australia, private health insurers and Maxawareness Pty Ltd ACN 119 859 166;
  21. carry out fundraising activities (where you have consented).
    1. Where possible and practicable, you will have the option to deal with Pit Stop SEQ on an anonymous basis or by using a pseudonym. However, if the personal information you provide us is incomplete or inaccurate, or you withhold personal information, we may not be able to provide the assistance or support you are seeking, or deal with you effectively.
  22. Disclosing your personal information
    1. Pit Stop SEQ will confine its disclosure of your personal information to the primary purpose for which that information has been collected, or for a related secondary purpose. This includes when disclosure is necessary to facilitate the provision of services to you by Pit Stop SEQ, to help us manage, conduct and oversee the Pit Stop SEQ’s businesses, or for security reasons.

  24. other businesses such as the business conducted by Maxawareness Pty Ltd ACN 119 859 166, where you are receiving services with Pit Stop SEQ under arrangements with that company;
  25. government departments responsible for health, aged care and disability where Pit Stop SEQ is required to do so;
  26. third parties contracted to provide services to Pit Stop SEQ, such as entities contracted to assist in accreditation or survey processes;
  27. research institutions with which Pit Stop SEQ collaborates;
  28. private health insurance providers and Medicare Australia;
  29. anyone authorised by you to receive your personal information (your authorisation may be express or implied);
  30. fundraising institutions associated with Pit Stop SEQ, where you have consented (your authorisation may be express or implied);
  31. anyone Pit Stop SEQ is required by law to disclose your personal information to.
  32. Data storage, quality and security
    1. Pit Stop SEQ will take reasonable steps to ensure that your personal information which is collected, used or disclosed is accurate, complete and up to date.
    1. All your personal information held by Pit Stop SEQ is stored securely in either hard copy or electronic form.

  • While Pit Stop SEQ aims to meet all requests for access to personal information, in a small number of cases and where permitted to do so by law, Pit Stop SEQ may not give access or may do so only under conditions. Subject to applicable laws, Pit Stop SEQ may destroy records containing personal information when the record is no longer required by Pit Stop SEQ.
  • Complaints

If you have a complaint about Pit Stop SEQ’s information handling practices or consider we have breached your privacy, you can lodge a complaint with Pit Stop SEQ’s Managing Director, using the contact details listed in clause 6 above. Pit Stop SEQ aims to deal with all complaints in a fair and efficient manner.  If you are not satisfied with the result of your complaint to us, you can refer your complaint to e Office of the Australian Information Commissioner.
